Refer-a-Friend Terms and Conditions

1. Who we are

Yoto SAS (we, us, our or Yoto) invites you to take part in our Refer-a-Friend Program (the Program), available on our website at yotoplay.com/referral-program (the Site).

2. Agreement to these terms

By using the Site or taking part in the Program, you agree to these terms and conditions. All decisions we make about the Program are final.

3. Privacy

We will collect, use and store your personal data as part of the Program, in line with our Privacy Policy.

4. Who can take part

To take part in the Program, you must be at least 18 years old. Employees of Yoto, including those working for its subsidiaries, Yoto affiliates, influencers or promotional agencies, are not eligible to participate.

5. How the program works

To make a referral, simply visit the Site and follow the on-screen instructions. When you make a referral, you become a Referrer and receive a unique referral link to share with your friend, family member or colleague. This link allows the Referrer to earn a voucher for all valid referrals. The person you refer (Friend) must follow the steps described in the referral message to complete the process and claim their own voucher.

6. Restrictions

You may only refer people you know personally. Referral links must not be shared on public or non-personal platforms such as social media pages, coupon or voucher sites, or other third party forums and marketplaces. You must not refer yourself or create multiple or fake accounts. You must not participate in the Program as both a Referrer and a Friend. You must not use the Program to break any laws or act in a way that is harmful, abusive, unlawful or inconsistent with the intent of the Program. You must not tamper with the Program, act unfairly, or use any automated tools such as bots to gain an advantage. If we believe that anyone is damaging or abusing the Program, we may refuse vouchers and take legal action.

7. Vouchers

Friend vouchers When a valid referral is made, the Friend will receive a Yoto voucher in the amount listed on the Site (Friend Voucher). A Friend Voucher may only be redeemed against the purchase of a Yoto Player or Yoto Mini (including player bundles). Each Friend Voucher remains valid until the end date specified in Yoto’s promotional communications for that particular offer, after which it will automatically expire. After the expiry date, any unused Friend Voucher will lapse and cannot be redeemed, reinstated, exchanged for cash, or otherwise compensated.

Referrer vouchers When the Friend’s order is delivered following their redemption of the Friend Voucher on an eligible purchase, the Referrer will receive a separate Yoto voucher in the amount listed on the Site (Referrer Voucher). Referrer Vouchers may be used toward the purchase of any product available on yotoplay.com, except for Yoto Club subscriptions. Referrer Vouchers may also be used alongside other promotions.

Any Referrer Voucher issued under this Program is valid for 6 months from the date it is issued. The Referrer Voucher will automatically expire at midnight on the date falling 6 months after the issue date. After the expiry date, any unused Referrer Voucher will lapse and cannot be redeemed, reinstated, exchanged for cash, or otherwise compensated.

General voucher terms All vouchers are subject to checks and approval. We may delay giving a voucher while we verify the referral. We may also choose not to approve a referral or issue a voucher for any reason.

If the value of your voucher exceeds the total amount of your purchase, the unused portion of the voucher will be forfeited. No change, credit, or cash equivalent will be given for any unused value. Each voucher can only be used once and must be redeemed in a single transaction.

Vouchers issued under this Program are promotional in nature and do not constitute a gift card. Unless we say otherwise, vouchers cannot be exchanged for cash, and are non-transferable.

8. Liability

YOU UNDERSTAND AND AGREE THAT THE RELEASED PARTIES (DEFINED BELOW) SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF YOTO WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). By participating in the Program, you agree to defend, indemnify, release and hold harmless Yoto, Extole, Inc. (as the provider of the referral service), and their respective parent companies, affiliates and subsidiaries, together with their respective employees, directors, officers, licensees, licensors, shareholders, attorneys and agents including, without limitation, their respective advertising and promotion entities and any person or entity associated with the production, operation or administration of the Program (collectively, the Released Parties), from any and all claims, actions, demands, damages, losses, liabilities, costs or expenses caused by, arising out of, in connection with, or related to the Program (including, without limitation, any property loss, damage, personal injury or death caused to any person(s)) and/or the awarding, receipt and/or use or misuse of any benefit in the Program. The Released Parties shall not be liable for any technical errors or malfunctions, data theft or corruption, any printing or typographical error, or any damage to any computer system resulting from participating in, or accessing or downloading information in connection with the Program. The Released Parties shall not be liable to any users for failure to supply any advertised voucher, by reason of any acts of God, any action or request by any governmental or quasi-governmental entity (whether or not valid), or any other activity or action that is beyond any of the Released Parties’ control. TO THE FULLEST EXTENT POSSIBLE BY LAW, THE RELEASED PARTIES’ MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH THE PROGRAM, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY, OR OTHERWISE), WILL NOT EXCEED £100.

9. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT: (A) THE PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS AND TERMS OF ANY KIND, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW OR CUSTOM, INCLUDING, BUT NOT LIMITED TO, WARRANTIES AS TO PRODUCTS OR SERVICES OFFERED THROUGH THE USE OF THE PROGRAM, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) THE RELEASED PARTIES MAKE AND GIVE NO WARRANTY THAT (i) THE PROGRAM WILL MEET YOUR REQUIREMENTS, (ii) THE PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, AND (iii) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE PROGRAM WILL MEET YOUR EXPECTATIONS, AND (C) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE PROGRAM IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF ANY SUCH MATERIAL.

10. Spam

You must not send mass messages, contact strangers or use the Program in a way that breaks the law. Doing so may result in you being removed from the Program and facing legal consequences.

11. Sign-in credentials

You are responsible for keeping your login details private. You are also responsible for all activities that occur through the use of your login details. If you think someone has accessed your account without permission, you must let us know immediately by contacting us via our support site at https://support.yotoplay.com/. We are not responsible for any loss or damage resulting from unauthorised use of your account credentials.

12. Changes to the Program

We may change, pause, or cancel the Program at any time and for any reason. We may disqualify any user from the Program if they do not comply with these terms and conditions.
